TERMS AND CONDITIONS

 

Please read these Terms and Conditions carefully before placing an order for terrariums from Bespoke Terrariums . By placing an order, you agree to be bound by these Terms and Conditions.

1. Definitions

• "Customer" or "you" means the individual placing an order for terrariums from us.
• "Terrarium" means a sealed or open glass container housing plants and soil, which you are purchasing from us.
• "Order" means your request to purchase terrariums from us.
• "Contract" means the legally binding agreement formed between you and us when we accept your Order.
• "Price" means the total cost of the Terrarium(s) and any applicable delivery charges, as displayed on our website or otherwise communicated to you.
• "Website" means our website at www.bespoketerrariums.co.uk (and .com).

2. Ordering Process

2.1. By placing an Order through our Website or other agreed-upon means, you are offering to purchase Terrariums subject to these Terms and Conditions.

2.2. Our acknowledgement of your Order does not constitute acceptance of your Order. A Contract will only be formed when we dispatch your Terrarium(s) or when we explicitly confirm our acceptance of your Order, whichever occurs earlier.

2.3. We reserve the right to refuse any Order at our discretion. If we refuse your Order, we will notify you and refund any payment you have made.

2.4. It is your responsibility to ensure that the details you provide during the ordering process are accurate and complete.

3. Products and Descriptions

3.1. We take reasonable care to ensure that the descriptions and images of our Terrariums on our Website or in other promotional materials are accurate. However, please note that: * As living items, plants may vary slightly in appearance, size, and colour. * Glassware may have minor imperfections that are inherent in the manufacturing process. * The appearance of colours may vary depending on your monitor settings.

3.2. All sizes and dimensions provided are approximate.

3.3. We reserve the right to make minor changes to the design or composition of our Terrariums without prior notice, provided that these changes do not materially affect the quality or functionality of the product.

4. Price and Payment

4.1. The Price of the Terrariums will be as displayed on our Website or as otherwise agreed with you.

4.2. Prices are stated in British Pounds (GBP) and are inclusive of any applicable Value Added Tax (VAT) unless otherwise stated.

4.3. Delivery charges, where applicable, will be clearly displayed at the checkout or otherwise communicated to you before you place your Order.

4.4. Payment must be made using the payment methods specified on our Website.

4.5. We take reasonable precautions to ensure that our Website is secure. However, you acknowledge that online payments carry inherent risks.

5. Delivery

5.1. We will deliver the Terrariums to the delivery address specified in your Order. It is your responsibility to ensure that this address is accurate and that someone is available to receive the delivery.

5.2. We aim to dispatch your Order within the timeframe stated on our Website or otherwise communicated to you. However, delivery times are estimates and are not guaranteed. We are not liable for any delays caused by events outside of our reasonable control.

5.3. Risk of damage to or loss of the Terrariums passes to you upon delivery.

5.4. Delivery charges and estimated delivery times will vary depending on the delivery location and the size/weight of your Order. Details will be provided during the checkout process.

5.5. For deliveries to certain locations within the UK (e.g., remote areas), additional charges or longer delivery times may apply. We will inform you if this is the case.

6. Care and Maintenance

6.1. We will provide basic care instructions with your Terrarium. It is your responsibility to follow these instructions to ensure the health and longevity of the plants within the Terrarium.

6.2. Please note that the lifespan of the plants within the Terrarium will vary depending on environmental conditions and the care provided. We cannot guarantee the long-term survival of the plants.

7. Returns and Refunds

7.1. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your Contract within 14 days of receiving the Terrarium(s) without giving any reason.  

 

 

 

7.2. To exercise your right to cancel, you must inform us of your decision by a clear statement (e.g., a letter sent by post or email to the contact details provided below). You can use the model cancellation form available on our Website, but it is not obligatory.

7.3. If you cancel your Contract, you must return the Terrarium(s) to us at your own expense without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation to us. The Terrarium(s) must be returned in the same condition in which you received them and, where possible, in their original packaging.  

 

 

 

7.4. We may make a deduction from the refund for loss in value of any Terrarium(s) supplied if the loss is the result of unnecessary handling by you.

7.5. We will process your refund within 14 days of receiving the returned Terrarium(s) or, if earlier, 14 days after you provide evidence of having sent the Terrarium(s) back. We will refund the Price you paid for the Terrarium(s), including the original delivery charges (except for any supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).  

 

 

 

7.6. Damaged or Faulty Terrariums: If your Terrarium arrives damaged or is faulty, please notify us as soon as possible, ideally within 48 hours of receipt, providing photographic evidence of the damage or fault. We will then discuss with you whether to offer a replacement, repair, or refund.

7.7. Exceptions to the Right to Cancel: The right to cancel does not apply to goods that are liable to deteriorate or expire rapidly (such as living plants once they have been dispatched and are outside of our control).

8. Liability

8.1. Nothing in these Terms and Conditions shall limit or exclude our liability for: * Death or personal injury caused by our negligence; * Fraud or fraudulent misrepresentation; or * Any other liability that cannot be excluded or limited under English law.  

 

 

 

8.2. Subject to clause 8.1, our total liability to you for any loss or damage arising out of or in connection with your Order shall be limited to the total Price you paid for the relevant Terrarium(s).

8.3. We shall not be liable for any indirect, consequential, or incidental loss or damage arising out of or in connection with your Order.

9. Intellectual Property

9.1. All intellectual property rights in and to our Website, its content, and the design of our Terrariums are owned by or licensed to us. You are not permitted to use, copy, reproduce, modify, or distribute any of our intellectual property without our prior written consent.

10. Data Protection

10.1. We will process your personal data in accordance with our Privacy Policy, which is available on our Website.

11. Governing Law and Jurisdiction

11.1. These Terms and Conditions and any Contract formed between us shall be governed by and construed in accordance with the laws of England and Wales.

11.2. Any disputes arising out of or in connection with these Terms and Conditions or any Contract shall be subject to the exclusive jurisdiction of the courts of England and Wales.  

 

 

 

12. Entire Agreement

12.1. These Terms and Conditions constitute the entire agreement between you and us and supersede all prior agreements, understandings, or representations relating to the subject matter hereof.
